These Terms of Service govern your access to clerive.com and your purchase or use of products and services offered by ClariveInfuse, trading as CLERIVE.

Throughout these Terms, “CLERIVE,” “we,” “us,” and “our” refer to ClariveInfuse.

By accessing the website, creating an account, or placing an order, you agree to these Terms.

1. Eligibility

You must have the legal capacity to enter into a binding agreement in your jurisdiction.

You agree to provide accurate, complete, and current information when using our services or placing an order.

2. Permitted use

You may use the website only for lawful personal or household purposes.

You must not:

Use the website for fraudulent or unlawful activity.
Submit false or misleading information.
Interfere with the website’s security or operation.
Introduce viruses, malware, or harmful code.
Attempt to gain unauthorised access to an account or system.
Scrape, reproduce, or commercially exploit website content without permission.
Infringe intellectual-property or privacy rights.
Use our products in violation of applicable law or product instructions.

We may restrict or terminate access where we reasonably believe these Terms have been violated.

3. Product information

We make reasonable efforts to present product descriptions, photographs, colours, packaging, dimensions, and prices accurately.

However:

Screen settings may affect colours.
Packaging may be updated.
Lifestyle images may contain illustrative elements.
Minor manufacturing variations may occur.
Availability is not guaranteed until an order has been accepted.

The CLERIVE diffuser is not an air filter and does not collect airborne particles.

Unless expressly stated otherwise and legally supported, CLERIVE products are not medical devices and are not intended to diagnose, treat, cure, or prevent disease.

Customers must follow all product instructions, warnings, and safety information supplied with the product.

4. Prices, taxes, and promotions

Prices are displayed in the currency selected for your market.

Applicable sales taxes, delivery charges, customs duties, and other fees may be calculated at checkout.

We may change prices before an order is accepted. Price changes do not affect orders already accepted.

Promotional prices and comparison prices apply only during the period or offer displayed.

5. Orders

Submitting an order constitutes an offer to purchase the selected products.

We may accept, reject, limit, or cancel an order for reasons including:

Product unavailability.
Payment failure.
Suspected fraud or unauthorised activity.
Incorrect pricing or product information.
Shipping restrictions.
Suspected commercial resale.
Violation of these Terms.

An automated order-confirmation email confirms receipt of your order but does not necessarily constitute acceptance.

An order is accepted when it is processed or dispatched.

If we cancel a paid order, the affected amount will be refunded to the original payment method.

6. Payment

You agree to provide valid and authorised payment information.

Payments may be processed by Shopify Payments, PayPal, card networks, banks, or other third-party providers.

Their terms and privacy policies may also apply.

7. Shipping and delivery

Delivery dates are estimates unless expressly guaranteed in writing.

You are responsible for supplying a complete and accurate delivery address.

CLERIVE is not responsible for delays or additional costs caused by incorrect or incomplete customer information.

8. Returns and refunds

Returns, cancellations, damaged products, and refunds are governed by our Refund Policy.

Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.

9. Intellectual property

The CLERIVE name, logo, packaging, images, graphics, website design, text, videos, product presentation, and other content are owned by or licensed to ClariveInfuse.

You may not copy, modify, publish, distribute, sell, license, or commercially exploit our content without prior written permission.

10. Reviews and customer content

When submitting a review, photograph, video, comment, or other content, you confirm that:

The content is based on your genuine experience.
You own it or have permission to submit it.
It does not violate another person’s rights.
It is not deceptive, defamatory, unlawful, threatening, or obscene.

You grant ClariveInfuse a non-exclusive, worldwide, royalty-free licence to reproduce, display, adapt, publish, and use submitted content for operating and marketing CLERIVE, subject to applicable law.

11. Third-party services

Certain website features may be operated by Shopify or other third-party providers.

CLERIVE does not control independently operated third-party websites and is not responsible for their availability, content, terms, or practices.

12. Disclaimer

To the maximum extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee that:

The website will always be uninterrupted.
Every technical error will be corrected immediately.
Every customer will experience identical results.
The website will be free from every harmful component.

Nothing in this section excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, ClariveInfuse and its owners, employees, suppliers, contractors, and service providers will not be liable for indirect, incidental, punitive, special, or consequential losses arising from use of the website or products.

Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.

Nothing excludes liability that cannot legally be excluded.

14. Indemnification

To the extent permitted by law, you agree to indemnify ClariveInfuse against claims, losses, liabilities, and reasonable expenses arising from:

Your unlawful use of the website.
Your violation of these Terms.
Your infringement of another party’s rights.

15. Severability

If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.

16. Termination

We may suspend or terminate access where these Terms have been materially violated or the website has been used unlawfully.

17. Governing law

These Terms are governed by the laws of the State of New Mexico and the applicable federal laws of the United States, without limiting mandatory consumer protections applicable where the customer lives.

Subject to any mandatory consumer right, disputes will be submitted to a court of competent jurisdiction located in New Mexico, United States.
